1. Subject of the Agreement

1.1 The Seller - the owner of the Internet trading site www.vimba.lv , hereinafter referred to as the online shop, and the related rights SIA "METELITSA", registration number 40103630935, legal address Daugavgrīvas iela 70 k-1 - 6, Riga, LV-1007, which, within the scope of its business activities, offers and sells goods to the Buyer on www.vimba.lv in accordance with this distance contract, hereinafter referred to as the Contract;

1.2. The Buyer - a person with legal capacity, who is considered a consumer within the meaning of the Consumer Rights Protection Law of the Republic of Latvia and who places an order at the online shop www.vimba.lv ;

1.3. By ordering the Goods from the Internet Shop, the Buyer agrees to the Terms and Conditions of Sale set out below. In the event that the Buyer does not agree to the terms of this Agreement, the Buyer shall cease shopping and leave the website www.vimba.lv

1.4. The Seller reserves the right to make changes to this Agreement and the Buyer agrees to keep www.vimba.lv regularly updated with any changes.

1.5. The Contract shall come into force at the time when the Buyer has placed and confirmed an order in accordance with the provisions of the "Placing and Processing of Orders" section of the Contract and shall remain in force until the obligations of the parties to the Contract have been fully performed.

2. Goods

2.1. For the purposes of this Agreement, the Goods are the goods offered by the Seller, the prices and description of which are set out in the Online Shop.

2.2. The photographs accompanying the Goods may differ from the actual and external appearance of the Goods. Depending on the type of Goods, the description of the Goods may include parameters, colour, size or special features which do not purport to be exhaustive and may contain typographical errors. 2.3. In the event that the Goods ordered by the Buyer are not in the Seller's stock, the Seller shall have the right to exclude the said Goods from the Order (i.e. cancel the Buyer's Order in whole or in part) or replace them with Goods of an analogous price.

2.4 The prices of the Goods in the Online Shop are quoted in Euro, inclusive of 21% value added tax.

2.5 The Goods are sold to the Buyer at the prices prevailing at the time the order is placed.

2.6 The price of the Goods does not include delivery charges. The delivery charge shall be calculated additionally and shall be reflected in the invoice taking into account the method of delivery chosen by the Buyer.

3. Order Processing

3.1 The Customer may order the Goods with or without registration at any time of the day or night.

3.2 When placing an order, the Buyer shall place the selected Goods in the "Shopping Cart" and fill in the order form, indicating the exact contact details (name, surname, e-mail address, telephone number, delivery method and address).

3.3. Orders shall be accepted and processed on working days from 10:00 to 19:00. During this period the Seller may contact the Buyer to clarify the information specified in the order. 3.4. After the order has been agreed, the Seller shall send an electronic invoice to the e-mail address provided by the Buyer. The Seller shall inform the Buyer of the invoice by sending a text message to the telephone number provided by the Buyer.

4. Payment procedure

4.1. The price of the Goods shall be indicated in the Online Shop.

4.2. The Seller has the right to provide discounts on the Goods and to establish a bonus programme.

4.3. Payment for the Goods and delivery shall be made by bank transfer or by PAYPAL transfer.

4.4. Payment for the Goods ordered from the Online Shop must be made by the Buyer within three working days of receipt of the invoice, otherwise the invoice will be cancelled.

4.5. Delivery of the Goods shall be arranged only after the full amount of the invoice has been credited to the Seller's bank account.

5. Delivery

5.1. The Seller shall arrange delivery of the goods ordered by:

5.1.1. Through DPD Latvija SIA to DPD parcel machines (delivery fee starting from EUR 3.50);

5.1.2. Through Omniva SIA to Omniva parcel machines (delivery fee starting from EUR 3.50);

5.1.3. Through Venipack SIA to Venipack parcel machines (delivery fee starting from EUR 3.50);

5.1.4. courier delivery via Omniva, DPD or Venipack. The delivery fee is calculated in accordance with the price list of the courier service;

5.1.5. If the Buyer wishes other delivery options, the Buyer must contact the Seller by calling +37128550990 or by sending an e-mail to vimbaveikals@gmail.com

5.1.6. The Buyer should note that the spinning rods will be delivered by courier services of SIA DPD Latvija and SIA Omniva or SIA Venipack.

5.2. After confirmation of payment, delivery is made within 2-7 working days. In special cases the delivery time may be extended and the customer will be informed thereof.

5.3. All Goods must be of satisfactory quality. If the Customer can prove, with reasoned evidence, that the Goods are unfit for use (by producing the Goods or a photograph of them on the date of delivery), the Seller shall exchange the Goods within five working days, in the same quantity and assortment, or, if there are no Goods given, in another assortment corresponding to the value of the Goods, or refund the amount of the Goods in question.

5.4. The Buyer may only make a claim upon acceptance of the order. If there are no claims and the Buyer has accepted the Goods from the courier, this is confirmation that the Buyer has no complaints about the composition of the Order, the quantity of the Goods and their external appearance.

5.5. The Buyer shall be notified of any delay in delivery of the Goods (e.g. during periods prior to public holidays) by e-mail or telephone.

6. Quality Guarantee

6.1 All Goods offered in the Online Shop shall be provided with a manufacturer's warranty in accordance with the legislation in force in the Republic of Latvia and the warranty terms and conditions established by the distributor of the Goods.

6.2 The manufacturer's warranty conditions are valid if the Buyer is able to present the proof of purchase, as well as the manufacturer's or distributor's warranty card, if such is included in the goods.

7. Right of withdrawal

7.1. If the Buyer, during the use of the product, finds that the product does not meet the quality requirements set by the manufacturer, the Buyer may exercise the right of withdrawal by making an objection in writing and sending it within seven working days to the following e-mail address: vimbaveikals@gmail.com

7.2. The Buyer is obliged to send the product to the Seller within seven working days after the statement of withdrawal. All costs incurred in returning the goods to the Seller shall be borne by the Seller.

7.3. The Buyer is responsible for maintaining the quality of the goods in the event of the exercise of the right of withdrawal. The Buyer shall be liable for any diminution in the value of the Goods if the Goods have been used in a manner incompatible with the principle of good faith, including for a purpose other than ascertaining the quality of the Goods. The Goods must be undamaged, without loss of appearance. The goods must be returned in their original packaging, in the same condition as when received, with the instructions for use and other accessories. If the Goods are not complete, damaged, untidy or not properly packed, the Seller shall have the right not to accept the Goods and not to refund the money paid by the Buyer for the Goods.

7.4. The Seller shall make a refund to the Buyer's account within fourteen working days of the Buyer's notice of rejection.

7.5. The Seller reserves the right to withhold the refund if the Buyer has not returned the goods to the Seller within fourteen working days of giving notice of refusal.

8. Liability

8.1. The Seller shall not be liable for any loss suffered by the Buyer as a result of the Buyer's improper use of the goods purchased from the Online Shop.

9. Data processing

9.1. By completing the order form at www.vimbaveikals.lv, the Buyer confirms that he has read and agrees that the personal data provided by him will be used to enable the Seller to process and fulfil the order - to identify the Buyer and receive the order, to process the order and delivery, to prepare accounting documents, including the invoice, to refund the overpaid amount and return the returned Goods, to administer financial obligations and other obligations arising from the Contract.

9.2. The Seller confirms that the personal data provided by the Buyer will be processed in compliance with the laws and regulations of the Republic of Latvia governing the processing and protection of personal data.

9.3. The Buyer's personal data will be stored for no longer than required by the stated purposes of data processing.
